1. Scope
These Terms and Conditions apply to all contracts concluded by consumers through the online shop pacecraftgoods.com with

For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
2. Contracting Party and Contract Language
The contracting party is Trendprodukte Felix Oberhage, trading as Pacecraft Goods.
The contract language is English. If content is also provided in other languages, such content is for informational purposes only. In case of doubt, the German version shall prevail.
3. Subject Matter of the Contract
The subject matter of the contract is the sale of goods through the online shop, in particular clothing and other physical products.
Some of the goods offered are produced using a print-on-demand process. Minor deviations in color, print result, positioning, or appearance compared to the product images shown in the shop may occur for technical reasons and shall not constitute a defect, provided such deviation is reasonable for the customer.
4. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to submit an order.
By submitting an order via the appropriately labeled button, the customer makes a binding offer to enter into a purchase contract.
After the order has been received, the customer will receive an automatic confirmation by email. This confirmation merely documents receipt of the order and does not yet constitute acceptance of the offer.
The contract is only concluded when we expressly accept the customer’s offer by email or dispatch the goods.
We reserve the right to reject orders in individual cases, for example if a product is unavailable or there are indications of an abusive order.
5. Storage of the Contract Text
The order data and these Terms and Conditions are displayed to the customer during the ordering process. After conclusion of the contract, the customer receives the order data by email. Any additional separate storage of the contract text for later retrieval by the customer shall only take place if this is technically provided within a customer account.
6. Prices and Shipping Costs
All prices shown in the online shop are final prices.
Shipping costs are charged in addition to the indicated prices unless stated otherwise in the respective offer.
For deliveries within Germany, the following currently applies:
- Shipping costs: €4.89
- Orders with a value of €74.99 or more qualify for free shipping
The shipping costs displayed during the checkout process shall apply.
7. Payment Terms
The customer may use the payment methods displayed in the online shop during the checkout process. These currently include in particular:
- PayPal
- Apple Pay
We reserve the right not to offer certain payment methods in individual cases or to add further payment methods.
Unless otherwise provided for under the selected payment method, the purchase price is due immediately upon conclusion of the contract.
8. Delivery, Delivery Time, and Customer Cooperation Obligations
Delivery shall be made to the delivery address specified by the customer within Germany.
The processing time is generally 2 to 5 business days. The delivery time after dispatch is generally a further 2 to 5 business days. The total delivery time is therefore generally 4 to 10 business days, unless otherwise stated for the respective product.
Delivery periods shall only commence once payment has been received in full, insofar as prepayment or immediate payment authorization is required.
If an ordered product is exceptionally unavailable, we shall inform the customer without undue delay. Any payments already made shall be refunded without undue delay.
The customer is obliged to provide a complete and accurate delivery address when placing the order. If additional costs arise due to an incorrect or incomplete address, such costs may be charged to the customer to a reasonable extent if the customer is responsible for the incorrect information.
9. Retention of Title
The goods remain our property until full payment has been received.
10. Transfer of Risk
If the customer is a consumer, the risk of accidental loss or accidental deterioration of the goods shall pass to the customer only upon delivery of the goods to the customer or to a person authorized by the customer to receive them. This aligns with EU consumer-distance-selling rules for delivery risk.
11. Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal.
Details of the right of withdrawal are set out in the separate Cancellation Policy / Right of Withdrawal and the Model Withdrawal Form provided in the online shop. EU distance-selling rules require pre-contract information and withdrawal information to be provided separately and clearly.
12. Statutory Warranty Rights
The statutory warranty rights shall apply.
Obvious transport damage should, where possible, be reported immediately to the delivery carrier and to us without undue delay. Failure to make such a report shall have no effect on the customer’s statutory warranty rights.
13. Liability
We shall be liable without limitation:
- in cases of intent or gross negligence,
- in cases of culpable injury to life, body, or health,
- under the provisions of the German Product Liability Act,
- and in all other cases where liability is mandatory by law.
In the event of a slightly negligent breach of essential contractual obligations, our liability shall be limited to the foreseeable damage typical for the contract. Essential contractual obligations are obligations whose fulfillment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.
In all other respects, liability for slightly negligent breaches of duty is excluded.
14. Product Presentation and Technical Deviations
We make every effort to display the products in the online shop as accurately as possible. However, due to technical factors, in particular different screen displays, printing processes, and material batches, minor deviations may occur between the representation shown in the shop and the actual delivered product.
Such minor, customary, or technically unavoidable deviations shall not constitute a defect, provided they do not impair the ordinary use of the goods.
15. Use of the Shop
The customer is obliged to provide truthful information when using the online shop and not to engage in any unlawful activities.
Use of the shop for commercial resale purposes is not permitted without our express consent.
16. Consumer Dispute Resolution
We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
17. Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
In relation to consumers, this choice of law shall apply only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence. This reflects EU consumer-contract principles on fairness, transparency, and mandatory consumer protection.
18. Final Provisions
Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
